CITIZENSHIP OF UKRAINE BY TERRITORIAL ORIGIN

Obtaining citizenship on the basis of territorial origin (by land law) is clearly provided for in Article 8 of the Law of Ukraine "On citizenship", which declares the grounds, territories and conditions for acquiring citizenship by territorial origin, as well as the Decree of the President of Ukraine on the detailed stages and steps of registration of checks in obtaining a decision on citizenship by foreigners or stateless persons. This category has the right to submit relevant documents for citizenship according to a simplified procedure and this procedure does not require a corresponding Presidential Decree. Territorial origin, in simple words, is blood ties with close relatives of the direct line who were born or lived on the territory of Ukraine before September 24, 1991. Due to the historical changes in the territory of Ukraine during the last century, they were recognized as different borders, such borders are listed in the Law of Ukraine "On citizenship". An important condition for registration of citizenship of Ukraine based on territorial origin is documentary evidence of the fact of birth or residence in the relevant territory of the region, district, city, village.

GROUNDS FOR ACQUIRING CITIZENSHIP OF UKRAINE BY TERRITORIAL ORIGIN

The fact of birth in the territory of Ukraine before August 24, 1991:

• a foreigner or stateless person
• one of the parents
• grandfather or grandmother
• great-grandfather or great-grandmother
• native brother or sister
• son or daughter
• grandson or granddaughter

A document confirming the fact of birth in Ukraine is a birth certificate. Documents that confirm the fact of family ties can be birth certificates and marriage certificates.

Important: minor children of the applicant also have the right to obtain Ukrainian citizenship together with their parents.

The fact of living in the territory of Ukraine until August 24, 1991:

Permanent residence of close relatives on the territory of Ukraine until August 24, 1991, which is confirmed by a court decision. In order to receive this decision, it is necessary to present documentary facts of residence in the territories provided for by the Law of Ukraine "On citizenship", as well as evidence of family ties. The list of close relatives for registration of citizenship by territorial origin on the basis of residence is similar to the basis of birth, which is provided for above.

PROCESS DOCUMENTATION OF CITIZENSHIP OF UKRAINE BY TERRITORIAL ORIGIN

Foreigners and stateless persons collect the appropriate package of documents, which corresponds to the basis of obtaining citizenship by territorial origin. The package of documents must be relatively new, i.e. the documents must not be older than 6 months (recommended), the certificate of criminal record - 2 months (recommended). Documents issued in other countries must be apostilled / legalized. The package of documents is submitted exclusively at the place of registration, if the foreigner / stateless person has a permit for temporary or permanent residence in Ukraine. If a foreigner/ stateless person does not have a residence permit, he/she has the right to submit documents at the place of actual residence with the appropriate notarial consent of the home owner. Relevant documents are submitted to the territorial division of the Migration Service of Ukraine with the person's personal presence.

DEADLINE FOR ACQUISITION OF UKRAINIAN CITIZENSHIP

From the moment of submitting the relevant package of documents and signing the application for Ukrainian citizenship according to the simplified procedure, the documents, after acceptance, are transferred to the main (central) department of the Migration service. Documents and grounds are carefully checked by the relevant authorized law enforcement agencies of Ukraine. The term of consideration of documents is up to 4 months, but there may be additional checks and the terms may be extended. These delays may be due to the verification of the compliance of the act record of a certain certificate.
