 CONFIRMATION OF THE CHILD'S UKRAINIAN CITIZENSHIP

A child who was born in Ukraine or abroad and at least one of whose parents is a foreigner or stateless person, and the other is a citizen of Ukraine, must confirm the citizenship of Ukraine. This is the procedure for choosing citizenship, which is done by the child's legal representatives - the parents. At the time of the child's birth, the parents receive a Ukrainian birth certificate, which indicates the country of birth, the place of residence, the parents and, necessarily, the citizenship of the parents. The child's birth certificate, which is issued by Ukraine in these cases, does not yet give the child full citizenship of our country, because the child can claim the citizenship of one of the parents, even if the parents have different citizenship. A child applying for Ukrainian citizenship can choose only one citizenship, this is clearly stipulated by the Constitution of Ukraine.

GROUNDS FOR CONFIRMATION OF THE CHILD'S CITIZENSHIP OF UKRAINE

Foreigners or stateless persons who gave birth to a child on the territory of Ukraine or outside its borders can complete the procedure for confirmation (acquisition) of Ukrainian citizenship for the child. The grounds for the confirmation of the child's citizenship (CCC) are provided for by Article 7 of the Law of Ukraine "On Citizenship", namely:

    1. A child, one of whose parents is a citizen of Ukraine, and the other is a foreigner
    2. A child born in Ukraine, whose parents are foreigners / stateless persons and live in Ukraine legally
    3. A child born in Ukraine, one of whose parents has been granted refugee/asylum status in Ukraine
    4. A child born in Ukraine to a foreigner or a stateless person living in Ukraine legally
    5. A newborn child found on the territory of Ukraine, whose parents are unknown

Important: Parents (one of the parents) must be in the territory of Ukraine on legal grounds!

Note: If the child was born abroad and both parents are citizens of Ukraine, the procedure of confirmation of the child's citizenship (CCC) is not required. The child can immediately be documented with a passport of a citizen of Ukraine for departure abroad at the embassy / consulate of Ukraine.

PROCEDURE FOR CONFIRMATION OF THE CHILD'S UKRAINIAN CITIZENSHIP

Documents confirming the Ukrainian citizenship of a child can be submitted:

  • in the embassy / consulate of Ukraine abroad, if the child was not born directly in Ukraine. After receiving a certificate of registration as a citizen of Ukraine, you can immediately make a citizen's passport for traveling abroad. Important: A child's birth certificate issued abroad must be apostilled / legalized depending on the country of issue of the document.
   • if the child was born in Ukraine, documents are submitted according to the place of residence (consent of the home owner) or registration of the place of residence of one of the parents. Foreigners or stateless persons must be in Ukraine legally at the time of submitting the package of documents. Documents are submitted to territorial units of the migration service. You need to get a ready certificate of citizenship at the main office. After receiving this certificate, you can apply to receive a passport for departure abroad for your child.

TIME LIMITS FOR CONFIRMATION OF THE CHILD'S CITIZENSHIP

Confirmation of the child's Ukrainian citizenship, after submitting a correspondent package of documents, is sent to the main offices for further processing and a certain amount of checks. Based on the result of the relevant decision, a certificate of registration of a person as a citizen of Ukraine is issued.
If one of the parents is a citizen of Ukraine, and the other is a foreigner / stateless person, then the processing of the documents takes up to 3 months from the moment of submission of the documents.
If the parents are foreigners, stateless persons, refugees or have been granted asylum in Ukraine, the period for processing documents takes up to 4 months from the moment of submission of documents.
