EMPLOYMENT PERMIT IN UKRAINE

During the period of active development of business in Ukraine, more and more often legal entities and individual entrepreneurs attract foreign specialists to work. One of the main conditions for the employment of a foreigner in a Ukrainian business entity is obtaining a permit to employ the labor of foreigners and stateless persons.
An employment permit is the main document of an officially working foreigner, which gives the full right to engage in work and hold a certain position at enterprises, institutions, and organizations in Ukraine. The presence of this document also enables a foreigner to obtain a temporary residence permit so that he/she can perform his/her work and stay in the territory of Ukraine for more than 90 days, or more than the term of the D-04 target visa (depending on the country).
The legislation of Ukraine provides for the grounds and conditions for obtaining an employment permit for foreigners and stateless persons. The most common work categories of foreigners, for which it is necessary to issue an employment permit:

    1. An employee;
    2. Foreign worker on a business trip;
    3. Founder/participant or ultimate beneficiary of a limited liability company established in Ukraine
    4. IT specialists.

The categories of employees must begin to perform their work duties (sign an employment contract) within 90 calendar days from the moment of obtaining an employment permit in Ukraine.
Documents for obtaining an employment permit are submitted on behalf of the business entity to the main offices of the employment center, regardless of the location of the business entity in Ukraine. The body that accepts documents for obtaining an employment permit at the Employment Center is the Administrative Services Center, regardless of location.
In order to hire a foreigner/stateless person for work, the entity of economic activity must work on certain employment characteristics, namely:

  • Position of a foreigner, according to the classifier of professions
  • Salary for the relevant category
  • Possible validity period of the employment permit for the relevant category

An entity of economic activity in Ukraine, when hiring a foreign citizen for work, must provide him/her with a salary not less than established one in the special law "On employment of the population", which regulates the procedure for employment of foreigners and stateless persons.

All documents are prepared by our lawyers, the employer only needs to certify them with the signature of the director and the seal of the company (if available). The draft employment contract (agreement) must be certified by the employer in accordance with DSTU 4163:2020.
The preparation of a complete package of documents must be done with the help of a lawyer, since at least one error in the documents leads to the suspension of the case examination by the employment center.
After submitting the documents, the employment center examines the processing of the documents. The deadline for making a decision on the issuance of a permit is up to 7 working days + 3 working days for the publication of the document.

From the date of receipt of the decision to issue a permit for employment of a foreigner/stateless person, a business entity that has hired a foreigner must pay the state duty to the Treasury of Ukraine according to the relevant details issued by the employment center. The amount of the fee for issuing or extending the validity of an employment permit for foreigners and stateless persons is calculated from the subsistence minimum per able-bodied person established by the Law on January 1 of the current calendar year.

IMPORTANT: The employer is obliged to conclude an employment contract (agreement) with a foreigner or stateless person no later than 90 calendar days from the date of issuance of the permit and within ten days after concluding the employment contract, provide a copy of it, certified by the employer, to the employment center. If the employer does not submit a copy of the concluded employment contract within this period, this permit will be revoked.

PROLONGATION OF EMPLOYMENT PERMIT

If, before the expiration of the employment permit, the foreigner wishes to continue working at the given position with the same employer, and the employer, in turn, does not object to the work of the foreigner, the permit may be extended for the same period. The employer must submit documents for extending the validity of the permit no later than 20 calendar days before its expiration.

The deadline for making a decision on prolongation of the validity of an employment permit is up to 3 working days + 2 days for publication. After receiving a decision on the extension of the validity of the employment permit, it is necessary to pay the state duty within 10 working days in accordance with the term of the prolongation of the validity of the permit.

MAKING CHANGES IN THE EMPLOYMENT PERMIT

During the period of their labor and entrepreneurial activity, certain changes may occur in the work of both the employer and the foreign employee. If data changes occur, such changes must be made in the employment permit.

In order for a foreigner to legally work in Ukraine, he or she needs to obtain a work permit.
