EXTENSION OF THE PERIOD OF STAY ON THE TERRITORY OF UKRAINE FOR FOREIGNERS AND STATELESS PERSONS

Many foreigners and stateless persons are on the territory of Ukraine as tourists, for certain business projects, employment, and other purposes. There are also cases when, for objective or subjective reasons, it is necessary to stay on the territory of Ukraine for a longer time than provided for by the legislation of the country. The reasons can be really serious, which gives the right to stay longer. This procedure of extension of stay must be documented and initiated in the bodies of the migration service with an appropriate application and a package of documents.

LEGALITY OF STAYING ON THE TERRITORY OF UKRAINE

Foreign citizens, as well as stateless persons, have the right to be on the territory of Ukraine in accordance with the legislation, as well as bilateral agreements between the countries. There are 2 modes of stay for foreigners / stateless persons:
    1. General - visa-free regime, when foreigners / stateless persons have the right to stay in Ukraine for a total of up to 90 calendar days within 180 days from the moment of first entry. These citizens are in Ukraine in a general tourist regime without a targeted trip to the country.
    2. Visa - regime according to which foreigners / stateless persons of a certain list of countries can be in Ukraine in accordance with the strict rules of an open visa in a foreign passport. There are many types of visas for entering Ukraine, each of them corresponds to the purpose of coming to Ukraine. Visas can be: short-term - "C", long-term - "D" and transit – "B".

GROUNDS FOR EXTENSION OF STAY

If foreigners and stateless persons who are in Ukraine need to stay for a longer period than stipulated by law, then they have the right to submit a relevant package of documents with a confirmed reason for such a stay.

There are the following reasons for extending the stay:

   • hospitalization or inpatient treatment in Ukraine
    • pregnancy (depending on the term)
    • care after a sick family member
    • submitted documents for citizenship
    • submitted immigration permit documents
    • natural disaster
    • paperwork on inheritance
    • not enough days to submit documents for a temporary residence permit in Ukraine
    • representation of a foreign mass media
    • vehicle repair

Grounds for extending the period of stay may be changed or added depending on the subjective situations of individuals or objective circumstances that may arise in the world, country, or region.

PROCEDURE FOR THE EXTENSION OF STAY

Citizens of foreign countries who are in Ukraine can submit documents to extend their stay in Ukraine in person in the following 2 cases:
1. They are legally located on the territory of Ukraine. Documents are submitted to the main offices of the migration service at the place (address) of residence, which is provided by the home owner (consent for residence).
Important: Documents for the extension of stay are submitted no later than 3 business days before the end of the legal period of stay (visa).
2. Are in Ukraine with a minor violation of stay. A minor violation can be up to 1 month, but it can be longer depending on the confirmation of the reason for the extension and the reason for such violation. In this case, first foreigners / stateless persons pay a fine for violation of the period of stay with the drawing up of a protocol on an administrative offense. The fine for violation of the period of stay can be from UAH 1700 to 7500, depending on the reason for the extension and the reasons for the violation of the period of stay. Documents are submitted to the main offices of the migration service at the place (address) of residence provided by the home owner (consent for residence).
Important: When submitting a package of documents for the extension of stay, a protocol on an administrative offense and a receipt for payment of a fine are attached.

The deadline for extending the period of stay is up to 5 business days from the moment of submission of a complete and correct package of documents. The authorized bodies carry out checks on the submitted documents and make the appropriate decision on extending the period of stay.
Important: The authorized body makes an appropriate decision regarding the expediency of the grounds for extending the period of stay in Ukraine.

RESIDENCE ADDRESS

Persons who are in Ukraine and have reasons to extend their stay with the necessary list of documents must add proof of residence in a certain territory of Ukraine. Confirmation of the place of residence (address) is a notarized consent of the home owner (if the owner is not present in person), or a verbal consent of the home owner in person at the time of submitting the documents together with the original ownership documents.
The residence permit does not constitute registration of the place of residence, but only temporary residence during the period of validity of the extension of the stay period. The address of the temporary place of residence is indicated directly in the foreign passport of the foreigner / stateless person in the stamp of the extension of the period of stay.

RECEIVING PARTY

Persons who decide to raise the issue of extending their stay must bring the host party with them along with a package of documents. The receiving party can be an individual or a legal entity, depending on the reason for extending the stay. The receiving party is responsible for the foreigner, regarding financial violations and undertakes to pay all expenses in connection with leaving the country. Depending on the receiving party, a corresponding package of documents is submitted.
